The Federal Postal Commission Urges Uber Eats Switzerland To Register As A Provider Of Postal Services

A moment, please, Uber Eats Switzerland! Before Uber Eats can deliver items in Switzerland, it must first be registered as a postal service provider, a legal hurdle since there is a process to follow here.

The food delivery app has been subject to the registration requirement that the Federal Postal Commission or the PostCom in Switzerland has imposed.

The Federal Postal Services Commission is Switzerland’s independent regulatory authority for the domestic postal market. It guarantees that the Swiss people and the economy get access to high-quality, and affordable postal and basic payment services, and oversees fair competition and working conditions among all commercial postal providers, like regulating online casinos.

PostCom has dismissed a previous appeal by Uber Eats Switzerland versus a decision it made last December 2023, and the Commission has classified Uber Eats as a courier service provider.

The deciding factor for the rule of law was that Uber Eats in Switzerland isn’t merely delivering prepared meals, but also items like cosmetics and daily products. The court classified these as postal items in the form of parcels, like what you get when you order from eCommerce stores like Lazada and Amazon.

Also, in an earlier ruling, the court had classified food deliveries in their totality as transport of items, which does not fall under the Postal Services Act. This time, everything has changed.

Uber Eats Switzerland isn’t completely agreeable to the requirement, arguing that it offers a general cargo transport service. Its business is to partially stop while it complies with the requirements. It is also claiming that the sorting stage, typical of postal services, was missing.
