Previously, Ridesharing Forum reported about the driver who got spilled with scalding tea over his private area with Starbucks being mandated to pay for the damages. This site has sourced information from ridesharing media, telling you that the famous internationall coffee chain has paid for those damages.
Mid-week recently, Starbucks has refused to pay those damages worthing to $50 million, citing the reason, it’s just too expensive.
“I think, basically, the damage award was not a surprise,” this Los Angeles Superior Court Judge Frederick Shaller said. “This is just part and parcel of trying cases in downtown Los Angeles. I don’t think it was unreasonable. Maybe the Court of Appeals will see it differently.”
Meanwhile, over at the Starbucks headquarters, their attorney, Rich Moore, is calling the jury’s verdict “grossly excessive” and “wildly disproportionate” to the injuries suffered by the plaintuff, Michael Garcia, who still feels far from recovery until today.
Moore is also saying the award for damages was “exponentially higher than any verdict in American history for a case like this.”
At the incident, Garcia was only ordering his preferred beverage from the coffee chain at a drive-thru when the staff suddenly spilled the tea on his private part, causing him to suffer from “severe burns, disfigurement, and debilitating nerve damage to his genitals,” according to the verdict of the jury panel.
The coffee company offered a $3 million initial pre-trial compensation, but the jury has ruled out he should likewise receive over $60 million after interest, with attorneys fees and costs added. This seems to be the reason why Starbucks has stalled the payment for the damages.
The judge also stated he has never seen such a cas like this, adding how it is “outrageous,” as well as Starbucks should have settled this once and for all, at that time.
“You asked for this verdict,” he added, the media told this team.
In the recent stories around, there are videos circulating online on what happened, but it is unsure whose party shared which.
Starbucks is staying firm on their decision so far.
In their official statement, the global coffee chain stated, “We respectfully disagree with this ruling and believe the verdict is contrary to the evidence and the law. We have always been committed to the highest safety standards in our stores, including the handling of hot drinks and are considering our next steps in the legal process.”
The team is closely watching on this unfolding.
