Postmates has been added to the list of ridesharing apps being issued for not paying their drivers well. In previous reports on this site, the team has shared stories of apps like Uber and Lyft being accused of underpaying their drivers.
“Attorneys working with ClassAction.org have finished their investigation into this matter,” stated a recent post on the website.
ClassAction.org is a website run by legal experts providing information about class action lawsuits, including news, updates, and resources for those who may be involved. While not fully managed by professional lawyers themselves, the site is run by online professionals who have a deep understanding of the legal industry.
Recently, the website has been alerted that Postmates is misclassifying drivers as independent contractors rather than employees, so they are being deprived of certain employment benefits, such as minimum and overtime wages. In a sudden, careless move, the ClassAction.org portal is saying they are gathering drivers to take legal action versus Postmates. Previously, Ridesharing Forum has had reports of drivers being classified as such, but not to this extent.
If the case is won, affected drivers could recover at least $2,000 or more in compensation, but the website is reiterating that “nothing is guaranteed.”
ClassAction.org is gathering insights from Postmates drivers who have worked over 40 hours in any week over the course of the past three years in Massachusetts, Illinois, New York, Oregon, or Washington.
“If you’ve worked for Postmates as an independent contractor in Massachusetts, Illinois, New York, Oregon, or Washington, you can now join others taking action against the company and potentially recover back pay and more. Those who sign up may be eligible for a claim worth $2,000 or more,” the website stated.
The procedure is pretty simple, so you could get your claim. However, remember that you’re signing up to participate in what’s known as mass arbitration, a kind of legal proceeding distinct from class action lawsuits, yet still lets a group of people essentially take part and take action against a company – Postmates, in this regard – they claim has done them wrong.
